3.2 Non-Custodial Nature

PumpSwap operates as a non-custodial platform. We never take possession, custody, or control of your cryptocurrency assets. You maintain complete control over your funds through your personal wallet.

3.3 Smart Contract Interaction

Transactions on PumpSwap are executed through smart contracts deployed on various blockchain networks. These smart contracts are autonomous and cannot be modified once deployed.

4. User Responsibilities

4.1 Account Security

You are solely responsible for:

• Maintaining the security of your cryptocurrency wallet and private keys
• All transactions conducted through your wallet
• Any unauthorized access to your wallet
• Safeguarding your login credentials and access devices

4.2 Transaction Verification

You agree to:

• Carefully review all transaction details before confirming
• Verify recipient addresses and amounts
• Understand that blockchain transactions are irreversible
• Accept responsibility for any errors in transaction details

4.3 Compliance

You agree to:

5. Prohibited Activities

You agree not to:

• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the operation of our platform
• Engage in any form of market manipulation or fraudulent trading

6. Fees and Charges

6.1 Trading Fees

PumpSwap charges a 0.3% fee on all cryptocurrency swaps. This fee is distributed to liquidity providers and helps maintain the protocol.

6.2 Network Fees

You are responsible for paying blockchain network fees (gas fees) required to process transactions. These fees vary based on network congestion and are paid directly to blockchain validators, not to PumpSwap.

6.3 Fee Changes

We reserve the right to modify our fee structure with reasonable notice. Continued use of our services after fee changes constitutes acceptance of the new fees.

7. Risks and Disclaimers

7.1 Market Risks

You acknowledge and accept the following risks:

• Volatility: Cryptocurrency prices can fluctuate dramatically
• Liquidity: Markets may lack sufficient liquidity for your transactions
• Slippage: Executed prices may differ from expected prices
• Impermanent Loss: Liquidity providers may experience losses due to price changes

7.2 Technical Risks

You acknowledge risks associated with:

• Smart Contracts: Potential vulnerabilities or bugs in smart contract code
• Blockchain Networks: Network congestion, forks, or failures
• Technology: Software errors, connectivity issues, or hardware failures
• Security: Potential hacking, phishing, or other security breaches

7.3 Regulatory Risks

Cryptocurrency regulations are evolving and may impact the availability or legality of our services in your jurisdiction.

8. Limitation of Liability

8.1 No Warranty

PumpSwap is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Damages

To the maximum extent permitted by law, PumpSwap and its affiliates, officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Trading losses or lost opportunities
• Damages arising from unauthorized access to your wallet
• Losses due to smart contract vulnerabilities
• Blockchain network failures or errors

8.3 Maximum Liability

Our total liability to you for all claims arising from your use of PumpSwap shall not exceed the total fees paid by you to us in the three months preceding the claim, or $100 USD, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless PumpSwap, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

10. Intellectual Property

10.1 Ownership

All content, features, and functionality on PumpSwap, including but not limited to text, graphics, logos, designs, software, and code, are owned by PumpSwap or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use PumpSwap for its intended purposes. This license does not include any rights to:

13.2 Termination by Us

We reserve the right to restrict, suspend, or terminate your access to PumpSwap if:

• We suspect fraudulent or illegal activity
• Required by law or regulatory authorities
• Your actions pose a security risk

13.3 Effect of Termination

Upon termination, your right to use PumpSwap immediately ceases. Provisions that by their nature should survive termination will remain in effect, including liability limitations, indemnification, and dispute resolution.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Finland.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PumpSwap regarding use of our services.
